12-16-12 MCRC Briefs


Twas' 11 days before Christmas, around 9:38
when 20 beautiful children stormed through heaven's gate.
Their smiles were contagious, their laughter filled the air.
They could hardly believe all the beauty they saw there.
They were filled with it - such joy, they didn't know what to say.
They remembered nothing of what had happened earlier that day.
"Where are we?" asked a little girl, as quiet as a mouse.
"This is heaven." declared a small boy, "we're spending Christmas at God's house."
When what to their wondering eyes did appear,
but Jesus, their savior, the children gathered near.
He looked at them and smiled, and they smiled just the same.
then He opened His arms and He called them by name.
And in that moment was joy, that only heaven can bring
those children all flew into the arms of their King.
And as they lingered in the warmth of His embrace,
one small girl turned and looked at Jesus' face.
And as if He could read all the questions she had
He gently whispered to her, "I'll take care of mom and dad."
Then He looked down on earth, the world far below
He saw all of the hurt, the sorrow, and woe
then He closed His eyes and He outstretched His hand,
"Let My power and presence re-enter this land!"
"May this country be delivered from the hands of fools"
"I'm taking back my nation. I'm taking back my schools!"
Then He and the children stood up without a sound.
"Come now my children, let me show you around."
Excitement filled the space, some skipped and some ran.
all displaying enthusiasm that only a small child can.
And I heard Him proclaim as He walked out of sight,
"In the midst of this darkness, I AM STILL THE LIGHT."  - author unknown

·        Message From AZGOP Chairman Tom Morrissey Regarding Open Meetings:It has come to my attention that there has been some confusion and problems with the Legislative and County organizational meetings. When this came to my attention I contacted our legal counsel, Lee Miller, who has given me the following points as we proceed with the rest of our organizational meetings.
1.    The membership of a county committee consists of every PC in the county. ARS 16-821.A.
2.    Only a PC elected on the August ballot is permitted to vote in an organizational meeting. ARS 16-821.B. A PC that filed to appear on the August ballot but was instead appointed a PC when the BOS canceled the PC election is deemed an “elected” PC. ARS 16-822.B. Note that PCs subsequently appointed may be nominated and win office, those individuals simply cannot make a motion or participate in the voting at the organizational meeting. AZ AG Opinion 85-003.
3.    Organizational meetings are functions of state law. The agenda at an “organizational meeting” should be limited to electing the statutory officers and state committee members.
4.    The Republican Party has through its bylaws allowed for PCs to participate in an organizational meeting via proxy. ARS 16-828. The form of proxy is printed in the Party bylaws. For purposes of a county meeting a proxy may only be carried by a “qualified elector” (another registered Republican) that resides in the same precinct as the proxy giver. ARS 16-828.A.2. Proxies given for a state meeting may be carried by a qualified elector that resides in the same county as the proxy giver. ARS 16-828.A.1. State law requires proxies to be attested to be either a notary or two witnesses. It is up to the notary or witnesses to decide in good conscience if they will sign off on a proxy that contains blanks.
5.    All State and County meetings are also governed by bylaws in addition to state law. Where there is a conflict between a bylaw and a statute the statute prevails. There are no statutory requirements for quorums at organizational meetings. There is a requirement for the outgoing chair to give notice of the time and place or a county or state organizational meeting. ARS 16-824.B. So, when the noticed date and time arrives the organizational meeting is called to order and those who are present either in person or proxy shall vote for officers and state committee members, regardless whether a “quorum” exists. This ensures that every county has their state committee members in place to receive notice of the state organizational meeting.
6.    As the organizational meeting is regarded as meeting of elected officials carrying out their statutory duties, Arizona’s open meeting law applies. The meeting must be open to the public and press. Remember that Open Meeting Law allows persons other than the elected officials to participate with their eyes and ears and not their mouths. Members of the public are not entitled to any opportunity to say anything and they may be asked to leave if they are disrupting the meeting.
7.    Every PC has a statutory right to participate in the organizational meeting or meeting to fill a legislative vacancy. Those are the only two instances where such rights exist. County and LD committees are free to adopt bylaws that terminate a PCs right to participate in any other activity of the committee. This is one of the principal reasons we encourage county and LD committees to have no other business on their organizational meeting agenda.

o   Korwin, author of five books and co-author of eight others, is a full-time freelance writer, consultant and entrepreneur with a 25-year track record. Alan is widely recognized as a leading expert on America's gun laws and has made nearly 1,000 radio and TV appearances. He is a founder and two-term past president of the Arizona Book Publishing Association, which has presented him with its Visionary Leadership award, named in his honor, the Korwin Award. Inclusive, sensitive, Di-ver-si-ty
Are words that were used to intimidate me.
At the top of the Senate, there arose such a clatter
To eliminate Jesus, in all public matter.
And we spoke not a word, as they took away our faith
Forbidden to speak of salvation and grace
The true Gift of Christmas was exchanged and discarded
The reason for the season, stopped before it started.
