·       Oooops:  Yesterday’s Briefs listed Delos Bond as the Chairman of the Cochise County Republicans.  Bond is chairman of the Apache County Republicans that passed nine resolutions since March and will be coming out with a statement on immigration in the near future.  Former Apache Chairman Barry Weller, who was listed as the Apache County Chairman, is the newly elected Apache County Supervisor – the first one in many years. Casey Jones is the chairman of the Cochise County Republicans. Three of the nine Apache County Resolutions are posted below.

·       Yavapai County Republicans Report A Successful Independence Day BBQ. Master of Ceremonies Jay Parkison started out the evening with a moment of silence for the fallen Yarnell Granite Mountain Hotshots.  AZGOP Assistant Treasurer (and bugler) , John Stevens performed “Taps.”  LD13 Rep Steve Montenegro gave the invocation.  "The Rusty Pistols" with Jim Dunham and Donn Pease played the "National Anthem".  Speakers included Sec. of State Ken Bennett, Sen. Melvin and former Tempe Mayor Hugh Hallman, AZ Corporation Commissioner Susan Bitter-Smith, Gila County Attorney Bradley Beauchamp,  and AZGOP Chairman Robert Graham. Bucky Buchaniec won the “Most Authentic Western Wear” contest judged by Barbara and Joel Schochet and Demenick Negri. Board of Supervisors Tom Thurman served as an auctioneer.

·       The United Republican Alliance Of Principled Conservatives (URAPC) is the official committee leading efforts to obtain enough signatures by Labor Day to put the “People’s Veto”  referendum of the November ballot to reverse the AZ Medicaid Expansion.  URAPC leadership consists of Christine Bauserman and former senators Ron Gould and Frank Antenori.  Bauserman cautions: “URAPC is the only organization that can submit petitions to the Secretary of State for this referendum,”  therefore, it is recommended that you follow only procedures and directives approved or disburst by URAPC.

o   The URAPC petition is filed with the Secretary Of State’s Office and URAPC petitions have R-01-2014 printed in the lower right-hand corner.

o   URAPC has not authorized any other organization to collect donations for URAPC petition signature gathering.

·       Best of luck to Director of Communications Matt Benson, who is leaving the Gov’s Office To Take A Position with the Phoenix-based public affairs firm Veridus, where he will be the Director  of communications and public affairs. Benson has been super to work with.  

Gov. Brewer comments: “It is with mixed emotions that I make this announcement, because Matthew has been a valued member of my team and has played a critical role in reaching the public and helping tell the story of my administration over these last few years,” said Brewer. “He is a talented communicator with keen political insight, and he has served this State with both composure and character. While I will miss him among my senior staff, I know he looks forward to devoting more time to his young family, and I wish him all the best.” Benson had served as Director of Communications for the Governor’s Office since January 2011. His departure is effective July 19, 2013.

 

·       Andrew Wilder Is The Governor’s New Communications Direction. He replaces Matt Benson who has taken a new position later this month. Wilder has been the Director of Communications at the Arizona Dept of Corrections. Wilder has also been on staff for then Congressman Jeff Flake, former Senator Jon Kyl, the National Republican Committee and Sen. John McCain.

A Resolution Of The APACHE COUNTY REPUBLICAN COMMITTEE In Opposition To The Governors Expansion Of Medicaid (AHCCCS) In Support Of Obamacare.

·       Whereas, The Voters of Arizona clearly expressed their will to reject implementation of the

Affordable Care Act (ObamaCare) when they voted to amend the Arizona Constitution via Proposition 106 in 2010. The State of Arizona cannot afford to be saddled with the costs of implementing this federal program. The People of Arizona do not support ObamaCare, assisting in the implementation of Obamacare, or subsidizing the Federal Government's implementation Obamacare with State funds; and

·       Whereas, The proposed "assessment" on hospitals is in reality just a tax - and worse yet a hidden tax - that will ultimately be passed on to all hospital patients in higher costs. A tax increase requires supermajority approval in the legislature per the Arizona Constitution and labeling it as an "assessment" is a disingenuous attempt to sidestep that Constitutional requirement; and

·       Whereas, No government entitlement program has ever effectively been scaled back, or eliminated, or held within its initial cost projections. The long term and evolving costs of the Obamacare Medicaid Expansion will surely bankrupt Arizona just as surely as Obamacare will bankrupt the Nation; and

·       Whereas, The US Supreme Court explicitly ruled that each State is free to reject

implementation of the Obamacare Medicaid Expansion and Insurance Exchanges. These two programs are the cornerstone of the Affordable Care Act. Without implementation of these programs Obamacare collapses as a practical functioning program. The Federal government is incapable of implementing these programs by 2014 or even 2016 without the local organization, legwork, and financial subsidies by the States. Thus the fastest and most efficient means to end Obamacare is simply for each State to refuse to do the Federal Government's job for them and allow the Federal Program to fail; and

·       Whereas, Governor Brewer touts AHCCCS as the conservative model for Medicaid and encourages us to expand the program to show the other states how to do it right. We believe There is no such thing as a conservative model for expanding Socialism. Supporting the big government takeover of our health care system, even for a short term gift of federal funds, does NOT reflect the values of the Republican Party or the interests of the taxpayers of Arizona.

Therefore it is Resolved:

The Apache County Republican Committee declare our opposition to the Governor's plan to

expand Medicaid in support of Obamacare.

In Conclusion:

While we applaud Governor Brewer's decision to oppose the Obamacare Exchanges, we oppose

her support for the Obamacare Medicaid expansion. We must stop State implementation of

both. We urge Governor Brewer, and all Republican legislators, to hold the line against enabling

the socialist takeover of our health care system and insurance industry by rejecting the

Medicaid expansion. Do not sell out our Republican principles and our birthright of Liberty for a

bowl of lentils and the promise of 3 years funding that will benefit a few special interests at the

cost of our State sovereignty and our core Republican values. We will adamantly oppose all

those who compromise our core values for short term political expediency. Governor Brewer is

correct that "elections have consequences". She is wrong in believing that It means that

Republicans must roll over and forsake our core values whenever Republicans lose a national

APACHE COUNTY REPUBLICAN COMMITTEE

RESOLUTION AFFIRMING THE 2ND AMENDMENT

·       WHEREAS, to prevent federal infringement on the right to keep and bear arms (RKBA); nuilifying federal acts in violation of the 2nd Amendment to the U.S. Constitution and Article 2 Section 26 of the Arizona Constitution;

·       WHEREAS, the 2nd Amendment of the U.S. Constitution reads, "A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.";

·       WHEREAS, Article 2 Section 26 of the Arizona Constitution reads, "The right of the individual citizen to bear arms in defense of himself or the State shall not be impaired, but nothing in this section shall be construed as authorizing individuals or corporations to organize, maintain, or employ an armed body of men.";

·       WHEREAS, all federal acts, laws, orders, rules or regulations regarding firearms are in violation of the 2nd Amendment to the U.S. Constitution and Article 2 Section 26 of the Arizona Constitution;

·       WHEREAS, the Natural Right of self-protection of Life, Liberty and Property is not granted by government, but by our Creator;

THEREFORE BE IT RESOLVED, the Apache County Republican Committee of the State of Arizona hereby declare and affirm; 1. All federal acts, laws, orders, rules, regulations in violation of the 2nd Amendment of the U.S. Constitution and the natural right of individuals to protect their life by means of adequate arms as outlined in Article 2, Section 26 of the Arizona Constitution, and are hereby declared to be invalid, shall not be recognized, are specifically rejected by, and shall be considered null and void and of no effect in this state.

FURTHER, it shall be the duty of the legislature of this State to adopt and enact any and all measures as may be necessary to prevent the enforcement of any federal acts, laws, orders, rules, or regulations in violation of the 2nd Amendment to the U.S Constitution.

ACRC Resolution: Liberty Preservation - Anti NDAA

WHEREAS, the Congress of the United States passed the National Defense Authorization Act,2011 P.L. 112-81, ("2012 NDAA") for Fiscal Year 2012 on December 15, 2011;

WHEREAS, the President of the United States of America signed the 2012 NDAA into law on December 31, 2011;

WHEREAS, Section 1021 of the 2012 NDAA purports to authorize, but does not require, the

President of the United States to utilize the armed forces of the United States to detain persons

the President suspects were part of, or substantially supported, al-Qaeda, the Taliban or

associated forces;

WHEREAS, Section 1021 of the 2012 NDAA purports to authorize, but does not require, the

President of the United States, through the Armed Forces of the United States, to dispose of such detained persons according to the Law of War, which may include but is not limited to: (I)indefinite detention without charge or trial until the end of hostilities authorized by the 200I

Authorization for Use of Military Force Against Terrorists, 2001 P.L. 107-40, (2) prosecution

through a Military Commission, or (3) transfer to a foreign country or foreign entity;

WHEREAS, Section 1021 of the 2012 NDAA seeks to preserve existing law and authorities

pertaining to the detention of United States citizens, lawful resident aliens of the United States,and any other person captured in the United States, but does not specify what such existing law or authorities are;

WHEREAS, Section 1021 of the 2012 NDAA purports enlarge the scope of the those persons

the Office of the President may indefinitely detain beyond those responsible for the September

11, 2001 terrorist attacks, and those who harbored them, as purportedly authorized by the 2001

Authorization for Use of Military Force Against Terrorists, to now include "[a person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces;"

WHEREAS, Section 1022 of the 2012 NDAA requires the Armed Forces of the United States to detain, pending disposition according to the Law of War, any person involved in, or whom

provided substantial support to, terrorism or belligerent acts against the United States, and whom is a member of Al-Qaeda or an associated force;

WHEREAS, The exemption for citizens of the United States in Section 1022 of the 2012 NDAA only exempts them from a requirement to detain and reads as follows, "The requirement to detain a person in military custody under this section does not extend to citizens of the United States";

WHEREAS, Unlike Section 1022 of the 2012 NDAA, Section 1021 makes no specific

exclusion for United States citizens and lawful resident aliens for conduct occurring within the

United States;

WHEREAS, the specific exclusion of application to United States citizens and lawful resident aliens contained in Section 1022 of the 2012 NDAA, and the absence of such exclusion in Section 1021 of the NDAA, strongly implies that the provisions of Section 1021 are intended to apply to all people, including United States citizens and lawful resident aliens, whether or not they are captured in the United States;

WHEREAS, the Office of the President of the United States, under both the administrations of George W. Bush and Barak H. Obama, has asserted the 2001 Authorization for the Use of

Military Force Against Terrorists allows the Office of the President to indefinitely detain without charge persons, including United States Citizens and lawful resident aliens, captured in the United States;

WHEREAS, United States Senator Carl Levin declared in colloquy on the floor of the United

States Senate that the original 2012 NDAA provided that section 1021 (then section 1031 prior to final drafting) specifically would not apply to United States citizens, but that the Office of the President of the United States had requested that such restriction be removed from the 2012 NDAA;

WHEREAS, during debate within the Senate and before the passage of the 2012 NDAA, United States Senator Mark Udall introduced an amendment intended to forbid the indefinite detention of U.S. citizens, which was rejected by a vote of38-60;

WHEREAS, United States Senator John McCain and United States Senator Lindsey Graham

declared in colloquies on the floor of the United States Senate that Section 1021 of the 2012

NDAA authorized the indefinite detention of United States Citizens captured within the United  States by the Armed Forces of the United States;

WHEREAS, United States Senator Lindsey Graham declared in colloquy on the floor of the

United States Senate that the United States homeland is now pall of "the battlefield;"

WHEREAS, Policing the United States of America by the Armed Forces of the United States, as purportedly authorized by the 2012 NDAA, over turns the Posse Comitatus doctrine and is repugnant to a free society;

WHEREAS, Sections 1021 and 1022 of the 2012 NDAA as they purport to authorize, 1)

detainment of persons captured within the United States of America without charge or trial, 2)

military tribunals for persons captured within the United States of America, and 3) the transfer of persons captured within the United States of America to foreign jurisdictions, are violative of the following rights enshrined in the Constitution of the United States of America;

• Article I Section 9, Clause 2's right to seek Writ of Habeas CO/pus;

• The First Amendment's right to petition the Government for a redress of grievances;

• The Fourth Amendment's right to be free from unreasonable searches and seizures;

• The Fifth Amendment's right to be free from charge for an infamous or capitol crime

until presentment or indictment by a Grand Jury;

• The Fifth Amendment's right to be free from deprivation of life, liberty, or property,

without Due Process of law;

• The Sixth Amendment's right in criminal prosecutions to enjoy a speedy trial by au

impartial jury in the State and District where the crime shall have been committed;

• The Sixth Amendment's right to be informed of the nature and cause of the accusation;

• The Sixth Amendment's right confront witnesses;

• The Sixth Amendment's right to Counsel;

• The Eighth Amendment's right to be free from excessive bail and fines, and cruel and

unusual punishment;

• The Fourteenth Amendment's right to be free from deprivation of life, liberty, or

property, without Due Process of law;

WHEREAS, Sections 1021 and 1022 of the 2012 NDAA as they purport to authorize, 1)

detainment of persons captured within the United States of America without charge or trial, 2)

military tribunals for persons captured within the United States of America, and 3) the transfer of persons captured within the United States of America to foreign jurisdictions, is repugnant to the following rights enshrined in the State of (Arizona) Constitution:

• Article 2 Section 4's right to be free from deprivation of life or liberty without Due

Process of law;

• Article 2 Section 3I ' s right to have prompt recourse to the laws for all injuries to one's

person;

• Article 2 Section 3's right to be free from unreasonable search and seizure (The Forth

Amendment);

• Article 2 Section 3's right to be free from capital charge absent a grand jury indictment,

or felony charge absent grand jury indictment absent information signed by the attorney

general (The Fifth Amendment);

• Article 2, Section 15's right to be free from excessive bail;

• Article 2 Section 14's right to bail and right to Habeas Corpus;

• ArticIe 2 Section 24' s right to a speedy pubic trial by an impartial jury, right to have the

assistance of counsel, and the right to be free from deprivation of life, liberty, or property,

unless by the judgment of peers;

• Article 2 Section 3's right to be presumed innocent until pronounced guilty by the law

(The Fifth, Sixth and Fourteenth Amendments, Section 3);

• Article 2 Section 23's right to a trial by Jury;

• Article 2 Section 20's requirement that the military authority is subordinate to the civil

authority;

WHEREAS, the members of this (THE ACRC (APACHE COUNTY REPUBLICAN

COMMITTEE) have espoused a firm commitment to uphold the Constitution of the United

States of America and the Constitution of the State of (ARIZONA);

WHEREAS, this (ACRC) opposes any and all rules, laws, regulations, bill language or

executive orders, which amount to an overreach of the federal government and which effectively take away civil liberties;

WHEREAS, it is indisputable that the threat of terrorism is real, and that the full force of

appropriate and constitutional law must be used to defeat this threat; however, winning the war against terror cannot come at the great expense of mitigating basic, fundamental, constitutional rights;

WHEREAS, undermining our own inalienable rights serves only to concede to the terrorists'

demands of changing the fabric of what made the United States of America a country of

freedom, liberty and opportunity.

NOW BE IT RESOLVED THAT, the (ACRC) of the (STATE OF ARIZONA, in APACHE

COUNTY). condemns in no uncertain terms Sections 1021 and 1022 of the 2012 NDAA and any future National Defense Authorization Acts that as they purport to 1) repeal Posse Comitatus and authorize the President of the United States to utilize the Armed Forces of the United States to police the United States of America, 2) indefinitely detain persons captured within the United States of America without charge until the end of hostilities as purportedly authorized by the2001 Authorization for Use of Military Force, 3) subject persons captured within the United States of America to military tribunals, and 4) transfer persons captured within the United States of America to a foreign country or foreign entity; and

BE IT RESOLVED, that the (ACRC) finds that the enactment into law by the United States

Congress of Sections 1021 and 1022 of the National Defense Authorization Act ofc2012, Public Law Number 112-81, is inimical to the liberty, security and well-being of the people of

(APACHE COUNTY. STATE OF ARIZONA). and was adopted by the United States Congress in violation of the limits of federal power in United States Constitution; and

BE IT RESOLVED, that all agencies of the (STATE OF ARIZONA) and in APACHE

COUNTY, are instructed to decline requests by federal agencies acting under detention powers of Sections 1021 and 1022 of the National Defense Authorization Act of2012 that could infringe upon residents' freedom of speech, religion, assembly, privacy, rights to counsel, or other rights not here explicitly enumerated; and oppose any future National Defense Authorization Acts that endanger the liberty and well-being of the people of APACHE COUNTY, which liberties are secured by the State of Arizona Constitution and by the Constitution of the United States of America; and

BE IT RESOLVED, That copies of this Resolution be immediately transmitted to the

Honorable Barack Obama, President of the United States, the President of the United States

Senate, the Speaker of the House of Representatives, each member of Congress from the State of (ARIZONA) to the Honorable John Roberts, Chief Justice of the United States Supreme Court; each justice on the United States Supreme Court; and the President of the Senate and the Speaker of the House of Representatives of each state's legislature.
