·        A Resolution To Censure Sen John McCain will be voted on at the Jan 11 Maricopa County Republican Precinct Committeemen’s  Mandatory Meeting in Phoenix. “As leaders in the Republican Party, we are obligated to fully support our Party, platform, and its candidates. Only in times of great crisis or betrayal is it necessary to publicly censure our leaders. Today we are faced with both. For too long we have waited, hoping Senator McCain would return to our Party’s values on his own. That has not happened. So with sadness and humility we rise and declare…”:  See Proposed Resolution #8  posted below:


·       Proposed Resolutions for the Jan 11 MCRC Mandatory Meeting:

RESOLUTION #1:  Resolution Supporting a Taxpayers’ Bill of Rights (TABOR)

ü  Whereas, taxpayers have a right to a government that does not grow beyond their ability to pay for it’ and

ü  Whereas, undisciplined government spending and tax increases irresponsibly burden taxpayers and harm economic performance, and

ü  Whereas,  during the Napolitano years, spending by Arizona state government increased on average twelve per cent annually while the state economy grew on average less than seven per cent annually, and

ü  Whereas, if Arizona government wants to protect its taxpayers and be fiscally responsible and disciplined, it needs a firm limit on revenue and expenditures, and

ü  Whereas, the most effective limitation measures have three common characteristics:

• Part of the state constitution and cannot be manipulated by politicians,

• Limit government expenditures to grow at the inflation rate plus population growth,

• Provide that surplus revenues be returned to the taxpayers, and

ü  Whereas, TABOR is a firm, fair discipline assuring the public that the state is serious about protecting the economy from a high tax burden, and

ü  Whereas, TABOR allows government growth at a slow and predictable rate and restrains government spending from exceeding that rate,

ü  Therefore, the Maricopa Republican Party of the State of Arizona resolves: TABOR provides a firm, fair discipline assuring the public our Republican legislators will protect the state economy from a high tax burden and will force legislators to look for efficiencies in government to avoid raising taxes as a first resort. - Submitted by Russell Pearce.


RESOLUTION #2:  Resolution Against the UnConstitutional Plyler v Doe decision

ü  Whereas, in 1982, the United States Supreme Court ruled, in one of its most overreaching decisions involving the 14th Amendment to the United  States Constitution, Plyler v. Doe (457 U.S. 202), that illegal alien children have a constitutional right to public education; and

ü  Whereas, the activist Court’s reasoning rested largely on, "no state shall . . . deny to any person within its jurisdiction the equal protection of the laws;" and

ü  Whereas, the Court in a 5 - 3 decision ignored the obvious logic that equal protection does not extend to foreigners illegally present in our country; and

ü  Whereas,  Plyer created an overwhelming financial burden for Americans; and

ü  Whereas, Plyer’s effects encourage a view of the United States as a universal nation without borders; and

ü  Whereas, the current practice of free public schooling to illegal aliens rewards them for violating American law and avoids the consequences of their illegal activities; and

ü  Whereas, Plyler v. Doe is a clear usurpation of congressional powers, one that Congress can fix simply by clarifying that the Equal Protection Clause cannot compel a state to provide discretionary taxpayer benefits to persons who are not legally present in the United States;

ü  Therefore Be it resolved by the Maricopa County Republican Party of the State of Arizona:  That the Precinct Committeemen of Maricopa County declare their opposition to Plyler v. Doe and that illegal aliens are not entitled to a free public education or entitled to any taxpayer funded program. - Submitted by Russell Pearce.


RESOLUTION #3:  Resolution Supporting Sheriff Joe Arpaio

ü  Whereas, citizens have a constitutional right to the protection from those who break our laws; and

ü  Whereas, attrition is achieved by enforcement; over 150 thousand illegal aliens have self- deported, we have a 46% reduction in crime, because of our laws strengthening enforcement; and

ü  Whereas, we protest the forgotten victims of this illegal alien impact, the deaths, maimings, job loss and economic burdens on our citizens as a result of this invasion; and

ü  Whereas, federal court decisions have affirmed the inherent authority of local law enforcement, "All officers whose duty it is to enforce criminal laws shall have authority to make arrests for a violation of any provision of this section" (affirmed US v Perez-Gonzalez 2002 Fed App 0360, 6th Circ.), and including the 2012 U.S. Supreme Court decision upholding SB1070 sec 2b specifically, and

ü  Whereas, U.S. Attorney General Ashcroft, Dept. of Justice declared that state and local police have inherent authority to enforce civil immigration laws; and

ü  Whereas, Sanctuary policies are illegal under federal law 8 USC 1644 and 1373 and Arizona law,

ü  Therefore, be it resolved the Maricopa County Republican Party of the State of Arizona condemns the actions of US DOJ, the courts, the leftist and profits-over-patriotism crowd that attempts to intimidate and thwart our duly elected Constitutional Sheriff Joe Arpaio from carrying out his Constitutional duty, and we strongly commend Sheriff Joe Arpaio for his relentless efforts to keep his Oath of Office in defense of the Constitutional rights of our citizens.  -- Submitted by Russell Pearce.


RESOLUTION #4:  Resolution Prohibiting Participation in Federal Violations of the 2nd Amendment of the People of the State of Arizona and Do Enact the Following:

ü  WHEREAS the 2nd Amendment to the Constitution of the United States states, “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed;” and

ü  WHEREAS the Legislature of the State of Arizona must declare all federal acts, laws, orders, rules and regulations in violation of the 2nd Amendment are not authorized by the Constitution of the United States and violate its true meaning and intent as given by the Founders and Ratifiers, and are hereby declared to be invalid, shall not be recognized, are specifically rejected and shall be considered null and void and of no effect in this state; and

ü  WHEREAS, no agency, political subdivision, or employee of such in this state shall: Enforce any federal act, law, order, rule, or regulation of the federal government regarding a personal firearm, firearm accessory, or ammunition within the limits of this State Provide material support, participation or assistance in any form, with any federal agency or employee engaged in the enforcement of any federal act, law, order, rule, or regulation of the federal government regarding a personal firearm, firearm accessory, or ammunition within the limits of this State,

ü  THEREFORE Be It Resolved By The Maricopa County Republican Committee That Arizona Is A 2nd Amendment State And The United States Constitution Compels The Legislature To Preserve States Rights And 2nd Amendment Liberty To The Full Extent Of The Constitution As Intended By Our Founders. -- Submitted by Russell Pearce.


RESOLUTION #5:  Resolution in support of U.S. Senator’s Ted Cruz, Mike Lee and those that stand with them and shaming all of those Republicans in Congress that voted with Obama Democrats to undermine the American People with UnConstitutional and unsustainable Obamacare and more debt.

ü  WHEREAS, the unsustainable Obamacare will hurt Americans with higher premiums, denied access, government mandates and huge costs, and

ü  WHEREAS, we must demand governments stops spending borrowed money and live within its means, and

ü  WHEREAS, along with Senate bill S. 744 that will undermine the rule of law by granting Amnesty to those here in violation of current law and will devastate millions of unemployed and under-employed Americans and will cost trillions of dollars in entitlements and healthcare, and

ü  WHEREAS, George Washington once asked, “Where are our Men of abilities? Why do they not come forth to save their Country?”; and

ü  WHEREAS, some Republican senators unjustly criticized Sen. Ted Cruz’s speech, sounding like leftist media elites, and

ü  WHEREAS, for more than three years, conservative Republicans in Congress and concerned citizens groups have sought in vain to defeat Obamacare, and

ü  WHEREAS, freshman Texas Sen. Cruz lead the effort to deny money to President Barack Obama’s prime legacy through his September 24 twenty-one hour Senate floor anti-Obamacare speech, and

ü  WHEREAS, he simply listed the dire effects of the law and impacts, on young people and old folks being denied freedom to choose over government ran healthcare, the American dream, and penalties imposed on families from government mandates, and

ü  THEREFORE, The Maricopa County Republican Party of Arizona applauds Senators Cruz and Lee in their steadfastness on the Republican platform, standing up against outrageous debt, reckless spending, outrageous federal takeovers of citizens’ healthcare and other critical issues facing this nation. -- Submitted by Russell Pearce.


RESOLUTION #6:  Resolution for Arizona’s Fair and Legal Employment Act HB2779

WHEREAS Arizona’s “Fair and Legal Employment Act” HB2779 is the most effective and non-discriminatory law enacted anywhere in the United States and upheld by the U.S. Supreme Court in a 5 to 3 decision; and

ü  WHEREAS HB2779 serves as an example of real comprehensive immigration reform for the rest of our nation; and

ü  WHEREAS on HB2779 Judge Wake said, "Those who suffer the most from unauthorized alien labor are those whom federal and Arizona law most explicitly protect. They are the competing lawful workers … in a wage economy depressed by the great and expanding number of people who will work for less;” and

ü  WHEREAS in 1986, Congress made it clear employers can only hire legal workers and to do otherwise is a felony; and

ü  WHEREAS using E-Verify Program puts the responsibility for verifying the documents on the government, with a 99.7% accuracy; and

ü  WHEREAS the people of Arizona should be proud Arizona is the first state to enact legislation that will truly prevent illegal immigrants from working in Arizona and put jobs for Americans first; and

ü  WHEREAS the law is simply, don't knowingly hire an illegal alien and you will never have to worry about the law;

ü  THEREFORE The Maricopa County Republican Party demands that Arizona’s Fair and Legal Employment Act be enforced. -- Submitted by Russell Pearce. 


RESOLUTION #7:  Tenth Amendment Resolution:

ü  WHEREAS, the 10th Amendment to the Constitution of the United States reads: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people"; and

ü  WHEREAS, the 10th Amendment defines the total scope of federal power as being that specifically granted by the United States Constitution and no more; and

ü  WHEREAS, the 10th Amendment clarifies that the federal government was created by the states specifically to be an agent of the several sovereign states; and

ü  WHEREAS, numerous resolutions have been forwarded to the federal government without any response or result from Congress or the federal government; and

ü  WHEREAS, many federal mandates are directly in violation of the 10th Amendment to the Constitution of the United States; and

ü  WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states;

ü  THEREFORE, be it Resolved by the Maricopa County Republican Party, that the State of Arizona shall claim sovereignty under the 10th Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the United States Constitution and that this resolution shall serve as notice and demand to the federal government to cease and desist, effective immediately, mandates that are beyond the scope of its constitutionally delegated powers. -- Submitted my Russell Pearce and Joel Alcott.


RESOLUTION #8:   Senator John McCain Censured by Arizona’s Republican Leadership - As leaders in the Republican Party, we are obligated to fully support our Party, platform, and its candidates. Only in times of great crisis or betrayal is it necessary to publicly censure our leaders. Today we are faced with both. For too long we have waited, hoping Senator McCain would return to our Party’s values on his own. That has not happened. So with sadness and humility we rise and declare:

ü  Whereas Senator McCain has amassed a long and terrible record of drafting, co-sponsoring and voting for legislation best associated with liberal Democrats, such as Amnesty, funding for ObamaCare, the debt ceiling, liberal nominees, assaults on the Constitution and 2nd amendment; and

ü  Whereas this record has been disastrous and harmful to Arizona and the United States; and

ü  Whereas Senator McCain has campaigned as a conservative and made promises during his re-election campaigns, such as the needed and welcomed promise to secure our borders and finish the border fence, only to quickly flip-flop on those promises; and

ü  Whereas McCain has abandoned our values and has been eerily silent against Liberals, yet publicly reprimands Conservatives in his own Party, therefore

ü  BE IT HEREBY RESOLVED that the Maricopa County Republican Committee censures Senator McCain for his continued disservice to our State and Nation, and

ü  BE IT FURTHER RESOLVED that until he consistently champions our Party’s Platform, we, the Republican leadership in Arizona will no longer support, campaign for or endorse John McCain as our U.S. Senator.


RESOLUTION #9:  Resolution To Repeal The 17th Amendment

ü  WHEREAS the federal government continually attempts to encroach more deeply into the lives and liberties protected by the Constitution of the United States; and

ü  WHEREAS the escalating cost & encroachment is reflected in federal budget deficits that have exceed record levels; and

ü  WHEREAS that federal debt burden mounts through reckless and irresponsible government fiscal and monetary policies,  enslaving unborn generations of Americans with a form of financial indentured servant hood; and

ü  WHEREAS many federal officials, be they elected or appointed, have an insatiable hunger to wield more and more power and control over the daily lives of ordinary American citizens; and

ü  WHEREAS our elected officials continue to distance themselves further and further  from the sentiments and interests of those who elected them to office; and

ü  WHEREAS the federal government expansion happens at the expense of the rights & responsibilities historically enjoyed by Sovereign States as guaranteed & secured by the Tenth Amendment to the Constitution; and

ü  WHEREAS for this reason our framers preserved the integrity of the sovereign states, and it is this federal system that the 17th Amendment destroyed;

ü  THEREFORE be it resolved the maricopa county republican party of the state of arizona demands the repeal of the 17th amendment and requests our legislature to pass a resolution to repeal the 17th amendment and return to the founding fathers’ formula for a balance of power between the federal government and the fifty sovereign states. -- Submitted my Russell Pearce.


RESOLUTION #10:  Resolution to Close Primary Elections

ü  Whereas, we have political parties for a reason, and

ü  Whereas, we must preserve the integrity of our elections at all cost, and

ü  Whereas, we are members of a political party with a platform we stand for, and

ü  Whereas, our open Primary process allows those who do not subscribe to the principles of this Party to vote in our Primary elections, and

ü  Whereas, our open primary system sometimes gives us a false choice of a candidate not supporting this Party’s platform or not the “True” Republican choice, and

ü  Whereas, it is unfair to our Party and the “True” Republican candidates who run this “open” Primary election system to allow those who oppose all or part of our platform to vote against the “True” Republican nominee and, instead, promote a candidate that is not the Republican choice, and

ü  Whereas these non-Republicans do this to hurt the nomination choice of the registered Party candidate to run in the General election, and

ü  Whereas, it is extremely unfair to allow this to continue and much more costly to the candidate to expend dollars electioneering to independents or others who have chosen not to be a member of our Party for whatever reason,

ü  Therefore be it resolved that the Maricopa County Republican Party encourages our Party’s leadership to immediately take all actions needed to close our Primary nomination/election to Republicans only.  -- Submitted my Russell Pearce.


RESOLUTION #11:  Resolution Urging the Institution of Caucuses to Nominate Candidates for General Elections

ü  WHEREAS, a Republican Party-only, binding, caucus-style process, wherein PCs in each political subdivision choose nominees to participate in general elections should be the process the Party promotes over the current open primary system; and

ü  WHEREAS, Republicans believe the First Amendment does not mandate forced association; and

ü  WHEREAS, Republicans oppose non-Republicans meddling in our primaries to maliciously elect weaker candidates; and

ü  WHEREAS, caucuses would empower PCs and make elected officials accountable to PCs; and

ü  WHEREAS, caucuses would fill empty PC slots; and

ü  WHEREAS, Republicans oppose subsidies and caucuses would reduce costs to taxpayers; and

ü  WHEREAS, Republicans believe in less government and primaries require larger government than caucuses; and

ü  WHEREAS, Republicans favor the battle of ideas over the dominance of money and special interests in nominating our candidates; and

ü  WHEREAS, Republican candidates could save money and have more time to fundraise for general elections; therefore be it

ü  RESOLVED, that the county party supports a binding caucus system to nominate candidates for general elections; and be it further

ü  RESOLVED, that the county party calls upon legislators representing Maricopa County to sponsor an amendment to the Arizona Constitution to allow parties to nominate candidates for each office by caucus; and be it further

ü  RESOLVED, that the county party urges all state committeemen to adopt a similar resolution at the next state party meeting; and be it further

ü  RESOLVED, that the county party urges each county party and district organization to adopt similar resolutions supporting a caucus process for selecting Republican nominees for general elections. -- Submitted by the LD 20 Caucus Committee.


RESOLUTION #12:  Resolution Against Amnesty

ü  WHEREAS, remember 1986 where amnesty was the failed solution of past federal legislation; and under S744 the following happens, amnesty increases cost in all areas of life for legal citizens; and

ü  WHEREAS, amnesty for the 12 to 30 million illegal aliens in the U.S. will cost taxpayers a minimum of $6.3 trillion according the Heritage Foundation, and

ü  WHEREAS, under S744 amnesty allows illegal-alien gang members, criminal and terrorists to be eligible; and

ü  WHEREAS, Judge Wake said, "Those who suffer the most from unauthorized alien labor are those whom federal and Arizona law most explicitly protect. They are the competing lawful workers, many unskilled, low-wage, sometimes near or under the margin of poverty, who strain in individual competition and in a wage economy depressed by the great and expanding number of people who will work for less”, and

ü  WHEREAS, amnesty actually serves to punish those legal foreign nationals that respect the law and seek to enter the country properly; and

ü  WHEREAS, amnesty would increase those eligible for Medicaid Expansion; and to become eligible for Supplemental Security Income, which is trillions in unfunded liability; and

ü  WHEREAS, Arizonans pay $2.6 billion annually to educate, medicate and incarcerate illegal aliens; and

ü  WHEREAS, amnesty rewards illegal aliens for breaking our laws; encourages more illegal border crossers; and

ü  THEREFORE BE IT RESOLVED that the Maricopa County Republican Party: demands Congress of the United States to strongly opposes S744 or any legislation supporting amnesty or the granting of lawful status to any person that has entered or remained in the United States illegally. -- Submitted by Russell Pearce.


RESOLUTION #13:  Resolution Supporting United States History Education

ü  WHEREAS, basic knowledge of U.S. history is essential to the survival of our Republic and unites a diverse people into a single Nation with a common purpose; and

ü  WHEREAS, citizens lacking knowledge of U.S. history lack understanding of the principles that define and sustain this Constitutional Republic, free people, liberty, justice, government by the consent of the governed, and the founding principles; and

ü  WHEREAS, the Center for Survey Research and Analysis at the University of Connecticut reveals 81% of seniors at elite colleges and universities cannot answer high school level questions about U.S. history and the Constitution; 78% cannot identify the source of the most famous line of the Gettysburg Address; and

ü  WHEREAS, many of America’s most distinguished historians are alarmed about the consequences for the Nation if the next generation of American leaders and citizens lose America’s memory of our inalienable rights and principles of self-government; and

ü  WHEREAS, the US Congress unanimously called upon state officials responsible for higher education to review public college and university curricula and promote requirements in U.S. history;

ü  THEREFORE BE IT RESOLVED the Maricopa County Republican Committee calls for: The Arizona Board of Regents and all officials responsible for education curriculum review all public college and university curricula and require basic U.S. history and the real history of our Founding Fathers and the Making of America, including our founding principles, the Declaration of Independence, Bill of Rights, Constitution, and important historical speeches during the Constitutional Convention. -- Submitted by Russell Pearce.


·       PROPOSED BY-LAW CHANGE -   Proposed: Article VI, Section 5B

No member of the MCRC shall lend an endorsement to a non-Republican candidate in any election. that has a Republican candidate on the ballot.    Should a MCRC member endorse a non-republican, that MCRC member will lose his voting privileges, including proxies, for the rest of his term. provided:

(1) The member was provided written notice mailed via certified US mail to the members last known address. (2) The member was provided an opportunity to defend himself at the next EGC meeting but not less than 10 days after notification; (3) The EGC by majority vote removed the members voting rights.        

Reason for support:

1.      To address situations in which there are no republican candidates in an election.

2.   To provide a due process for removing a PCs voting rights.

Proposed:  Article II Section 2E 10

The PC shall is strongly request to provide the district, county, and state party offices with their email addresses, if they have one.   District, county and state party offices may not allow e-mail addresses to be used for any purpose other than internal party communications and shall not distribute an e-mail address to anyone, including other PC's without the express consent of the affected precinct committeeman

Reason For Support:

 1.     To provide District, County and State Party Leadership the ability to communicate with most all precinct committeemen via email, saving significant time and money.

2.    To provide safeguards for the use of a PC's email account. -- Ray Malnar - LD20 Chairman  & MCRC bylaws committee chairman
