·       Every Election Cycle Briefs Gets Reports Of Damage To Political Signs. This afternoon reports  came in that some of the signs for the LD13 M&M Team – incumbents Darin Mitchell and Steve Montenegro – were knocked down in the Surprise/Sun City/Wickenburg areas (not wind damage).  If you observe anyone damaging signs, it has been suggested that you photograph the action and send the photos to the candidate’s whose signs are being damaged. Here is ARS 16-1019 as a reminder that tampering with political signs is a class 2 misdemeanor.

 

·       ARS 16-1019  Political signs; printed materials; tampering; classification
A. It is a class 2 misdemeanor for any person to knowingly remove, alter, deface or cover any political sign of any candidate for public office or knowingly remove, alter or deface any political mailers, handouts, flyers or other printed materials of a candidate that are delivered by hand to a residence for the period commencing forty-five days before a primary election and ending seven days after the general election.
B. This section does not apply to the removal, alteration, defacing or covering of a political sign or other printed materials by the candidate or the authorized agent of the candidate in support of whose election the sign or materials were placed, by the owner or authorized agent of the owner of private property on which such signs or printed materials are placed with or without permission of the owner or placed in violation of state law or county, city or town ordinance or regulation.
C. Notwithstanding any other statute, ordinance or regulation, a city, town or county of this state shall not remove, alter, deface or cover any political sign if the following conditions are met:
1. The sign is placed in a public right-of-way that is owned or controlled by that jurisdiction.
2. The sign supports or opposes a candidate for public office or it supports or opposes a ballot measure.
3. The sign is not placed in a location that is hazardous to public safety, obstructs clear vision in the area or interferes with the requirements of the Americans with disabilities act (42 United States Code sections 12101 through 12213 and 47 United States Code sections 225 and 611).
4. The sign has a maximum area of sixteen square feet, if the sign is located in an area zoned for residential use, or a maximum area of thirty-two square feet if the sign is located in any other area.
5. The sign contains the name and telephone number or website address of the candidate or campaign committee contact person.
D. If the city, town or county deems that the placement of a political sign constitutes an emergency, the jurisdiction may immediately relocate the sign. The jurisdiction shall notify the candidate or campaign committee that placed the sign within twenty-four hours after the relocation. If a sign is placed in violation of subsection C and the placement is not deemed to constitute an emergency, the city, town or county may notify the candidate or campaign committee that placed the sign of the violation. If the sign remains in violation at least twenty-four hours after the jurisdiction notified the candidate or campaign committee, the jurisdiction may remove the sign. The jurisdiction shall contact the candidate or campaign committee contact and shall retain the sign for at least ten business days to allow the candidate or campaign committee to retrieve the sign without penalty.
E. A city, town or county employee acting within the scope of the employee's employment is not liable for an injury caused by the failure to remove a sign pursuant to subsection D unless the employee intended to cause injury or was grossly negligent.
F. Subsection C does not apply to commercial tourism, commercial resort and hotel sign free zones as those zones are designated by municipalities. The total area of those zones shall not be larger than three square miles, and each zone shall be identified as a specific contiguous area where, by resolution of the municipal governing body, the municipality has determined that based on a predominance of commercial tourism, resort and hotel uses within the zone the placement of political signs within the rights-of-way in the zone will detract from the scenic and aesthetic appeal of the area within the zone and deter its appeal to tourists. Not more than two zones may be identified within a municipality.
G. A city, town or county may prohibit the installation of a sign on any structure owned by the jurisdiction.
H. Subsection C applies only during the period commencing sixty days before a primary election and ending fifteen days after the general election, except that for a sign for a candidate in a primary election who does not advance to the general election, the period ends fifteen days after the primary election.
I. This section does not apply to state highways or routes, or overpasses over those state highways or
routes.

 

·       Congressman Matt Salmon: Humanitarian Border Crisis - Earlier this month, Speaker John Boehner appointed me to a working group to advise Congress on how to best address the humanitarian and security needs at the United States border.  The group will be chaired by Rep. Kay Granger (TX-12) and I will be joined by Rep. John Carter (TX-31), Rep. Mario Diaz-Balart (FL-25), Rep. Bob Goodlatte (VA-06), Rep. Michael McCaul (TX-10), Rep. Steve Pearce (NM-02). We had our first meeting Thursday, July 3, and will be introducing legislation to address the crisis in short order. ·       Maricopa County Elections Has Requested the Maricopa County Republican Committee (MCRC) provide sixty (60) Republican workers to help with the official Hand Count/Audit Board for the August 26 2014, Primary Election.  We still need twenty-five (25) more volunteers. If interested, please e-mail A. J. LaFaro at aj_ml@hotmail.com your full name, mailing address, city, zip, voter id, phone number and e-mail by Monday July 14 2014.  The MCRC Chairman has to coordinate and approve everyone that wants to work.   Below is some specific information about this project -

·       The pay rate is $10.00 per hour, but in order to compensate you for your participation, County Elections must have your social security number on file within their office.  

·       The Hand Count/Audit Board will initially meet at 2 PM, Wed, Aug 27, 2014 at the Sheriff’s Training Facility,  2627 S. 35th Ave, Phoenix, AZ.  Check-in will begin a half hour prior to each designated time noted below and parking is reserved for this process, County Elections  encourages you to carpool, if possible.

·       The schedule for this undertaking is as follows:

·       Wed, Aug 27  from 2- 4 pm – Check-in and Training for Hand Count/Audit Board

·       Thurs, Aug 28 from 9am -5 pm – Counting (may complete the audit on this date)

·       Fr, Aug 29 from 9 am-5 pm– Counting (if necessary)

·       Meet LD11 House Candidate Jo Grant: After serving as a staffer for the Arizona State Legislature for 30 years, retiring in 2013. She held the role of Legislative Coordinator for the Southern Arizona Legislative Office for 26 of those years.  Grant was married for 31 years to Jeff Grant, who passed away in January 2013. ·       Congressman Matt Salmon: June was a busy month in the House of Representatives and across the country.  We’ve faced numerous new challenges, and the House has worked quickly to address the new challenges we face today. As you know, we’ve also seen an unprecedented increase in illegal immigration on our southern border—especially of unaccompanied children.  I held a hearing where I sought answers on how we can best address the humanitarian crisis that is unfolding as a result of this immigration, and look forward to working with my colleagues to find real solutions to secure our borders and address the crisis. Recently, more revelations about the state of the Veterans Administration came to light.  The House took quick action and passed bills to address what is, in my opinion, the largest VA scandal we have yet seen.  Closer to home, I’m working with other members of our Arizona delegation to monitor the situation at the Phoenix VA to ensure our veterans locally are receiving the care they deserve in a timely fashion. ·       Supt Of Public Instruction Candidate Diane Douglas: On Thursday, July 3rd, Diane Douglas received her $97,620 in Clean Elections funding for the Primary Election. “I am very thankful for the strong outpouring of support from across Arizona. The response to our platform of eliminating Common Core has been overwhelmingly positive,” stated Douglas. ·       Gubernatorial Candidate Doug Ducey: As you may know, a deep-pocketed third party group has begun airing TV ads recycling all the false charges leveled at me during the 2010 campaign. It’s the first wave of several attacks to come, both personally and about my leadership of Cold Stone Creamery.  Our campaign has vaulted into a strong position for the August primary, and so the negative ads against me have now begun. Last night the group filed intentions to spend $750,000 in negative ads, and I need your help to fight back. ·       LD11 House Candidate Jo Grant: This past Monday night Jo Grant appeared with the two additional candidates for LD 11 House of Representatives in a candidate’s forum.  The candidates were to ask one question of another candidate, by a drawing of names.  Grant asked candidate Finchem how he can be a conservative and believe in limited government while taking taxpayer money for his campaign in the form of Clean Elections dollars.   He said, "Clean Elections is funded by tax payers by choice. When you file your income tax there is a box on your income tax that says I want to give $5 to keep the electoral process out of the hands of special interest. I don’t accept PAC money." Sadly he is very misinformed on who is paying for his campaign. From the Clean Elections 2013 annual report:
