With Less Than 10 Days To Go until the Jan 14 Maricopa County Republican Committee’s (MCRC) Mandatory meeting, Attorney General Mark Brnovich’s newly appointed Solicitor General Dominic E. Draye yesterday issued an “informal opinion” to House Speaker Elect J. D. Mesnard that Call Letters delivered by “email appears insufficient to satisfy A.R.S. § 16-824.” See full document at

Attorney Ted Naeckel Responds To AG Opinion: I saw the “opinion” from Bronovich. He clearly acknowledges that his “opinion” is hasty and not well researched. The only authority for USPS mail that he sites only is in the rules of court and rules of civil procedure for serving documents another party and is inapplicable in terms of a call letter to PC’s because court procedure is a specialized circumstance and the sole purview of the courts.   It has no binding application to “normal” areas of the law.  The definitions section of the Arizona Revised Statutes does not define “mail” as being only Snail mail.  Nor does Title 16, which deals expressly with the political structure set up by the state, define “mail”.  Further, depending on the dictionary, I can find the term “mail” to include e-mail. Because the definition of “mail” is not established anywhere other than the court rules of civil procedure, e-mail is not precluded under title 16. With the new “e-filing” system, everything but the initial service of a complaint is done by e-mail now. And, the initial service can also be done by the agreement of the parties.

Yesterday, Arizona Attorney General Mark Brnovich announced the appointment of Dominic Draye as Solicitor General. Draye replaces John R. Lopez IV who left office to serve as an Arizona Supreme Court Justice. The Solicitor General's duties include leading the AZAG Federalism Unit and overseeing preparation of legal opinions and appellate litigation for the Arizona Attorney General’s Office. Since 2015, Draye has served as the Deputy Solicitor General.  In that capacity, he represented the State in a wide range of appeals, including defending the State’s policy of withholding driver’s licenses to DACA beneficiaries. Draye also led a 10-state coalition challenging the EPA’s new ozone regulations and defended Arizona’s identity theft and forgery laws.

Due To Conflicting Stories regarding whether AZGOP Chairman candidate Jim O’Connor carried two (2) or nine (9) proxies to the Dec 1, LD23 Organizational meeting, Briefs requested that newly elected LD23 Chairman Nancy Ordowski and keeper of the election records, recheck the paper work to see how many proxies O’Connor carried and how many ballots he cast. Ordowski has confirmed, for the second time, that O’Connor carried two proxies – one for his wife and one for his son (as previously posted in Briefs.) Ordowski said, “I do have the paper work and Jim did only turn in 2 proxies.  There are only 10 PCs in Del Joya Precinct and none of the others attended or sent a proxy. The 3 voters in Jim's precinct were:  Jim O'Connor-in person, Merrill O'Connor - by proxy and Michael O'Connor - by proxy.”

      · MCRC Chairman candidate Chris Herring: Over the past couple years I've worked to get conservatives elected  and grow the party in several positions. I've served as the Chairman, first vice chairmen, and 2nd vice chairmen of LD21. I've led PC trainings in the West Valley attended by PCs from 8 different LDs. In the presidential election cycle I worked alongside the Ted Cruz campaign in the primary and then alongside the Trump campaign. I ran the phone banks and GOTV walks in the West Valley during the general election. I also coordinated with the Arpaio campaign recruiting volunteers to phone bank remotely. In Jan. 2015 I founded the Maricopa County Young Republican Professionals. This is the only recognized chapter of YRs in the county. I've grown the chapter to over 130 members and set up the organization with solid financial footing when a new president is elected for the chapter this year. The Jersey City teachers union has negotiated a contract that requires the city to pay for teachers who don't teach, and instead spend their entire time on union business. The Maricopa County Republican Statutory Meeting is scheduled Jan 14, 2017 at the El Zaribah Shriner’s Auditorium, 552 N. 40th St, Phoenix, AZ 85008, not the Polly Rosenbaum Building, as originally announced. Contrary to reports, the Shriner’s auditorium has NOT been renamed the Polly Rosenbaum Building. They are located on the opposite sides of metropolitan Phoenix, so be sure you are heading for the Shriner’s Auditorium. You don’t want to arrive late for credentials registration.

Regarding the Jan 3, 2017 MCRC Briefs link to the WND article posted by Freedom Outpost, the following claim was made: “The investigator for Sheriff Joe Arpaio’s team that reviewed the authenticity of the document the White House posted as ‘proof positive’ of Barack Obama’s Hawaiian birth says [Hawaii] state officials never confirmed the document’s validity.” WND  The state of Hawaii Department of Health provided a hard copy of President Obama’s long form birth certificate to his personal legal counsel, who hand carried the document to the White House. The document was then scanned and converted into a computer generated PDF and uploaded and displayed on the White House website, April 27, 2011. In May of 2012, the information contained on the PDF image was validated not once but twice by the state of Hawaii Department of Health, once for Arizona and once for the Democratic Party of Mississippi in the form of Verifications of Birth, serving as prima facie evidence. In other words, according to Black’s Law Dictionary, the “evidence is good and sufficient on its face.” I’ve included links to Hawaii state law and definitions, as well as both copies of the Verifications of Birth for Barack Obama. I’m satisfied that the information contained on the PDF depiction of Barack Obama’s birth certificate is authentic and he was born in the United States and is a citizen of the United States. I’m also satisfied that the Trump Administration will never, ever take on this Arpaio boondoggle, based on the evidence issued by the state of Hawaii. (1) (2) (3)

Congressmen Trent Franks (R-AZ), Ron DeSantis (R-FL), and Lee Zeldin (R-NY) introduced a bill yesterday to “recognize Jerusalem as the capital of Israel and to transfer to Jerusalem the United States Embassy located in Tel Aviv”. Franks released the following statement about the timing of this legislation: “The Congress of the United States has favored moving the American Embassy in Tel Aviv to its rightful place in Jerusalem for a long time but under the Obama Administration that has proved impossible. President Obama’s recent move at the UN to undermine Israel’s very right to exist was the ultimate betrayal. President Elect Trump has been openly supportive of moving the Embassy and we believe this is the time to make a bold statement that Jerusalem should remain the undivided and unequivocal capital of Israel.”

Congressman Andy Biggs Submits Two Amendments for the REINS Act The REINS Act seeks to restore oversight authority to Congress for any major federal regulation that could potentially cost the U.S. economy at least $100 million. Biggs also testified in front of the House Rules Committee on behalf of his two amendments yesterday afternoon. “I am pleased to have offered up two amendments to the REINS Act and to have defended the amendments in the Rules Committee,” Biggs said. “Many small businesses and individuals in my district have been negatively affected by the ripple effect caused by an out-of-control rules-making process by unelected and unaccountable federal bureaucrats. I promised my constituents that I would strongly support the REINS Act, and I have kept my promise. I will continue to push for the passage of the REINS Act to ensure that Congress takes back this very-important job of rule-making oversight.” Biggs’ testimony - Rules Committee. Biggs offered these two amendments:

· Amendment #4: Defines all rules promulgated by the Environmental Protection Agency as “major.”

· Amendment #5: Lowers the annual economic effect threshold for a major rule from $100,000,000 to $50,000,000.
