AzCDL Legislative Action Alert: The Republican leadership in the Legislature is showing an increasing reluctance to allow pro-rights firearms bills to be scheduled for floor votes.  One of these, HB 2535, passed out of the House Judiciary and Public Safety committee on February 14, followed by passage out of the House Rules committee on February 19.  The next step for HB 2535 is a House Committee of the Whole (COW) hearing, which can only be scheduled by the House Leadership. HB 2535 would prohibit the Department of Child Safety (DCS), a child welfare agency or a governing board of a child welfare agency from adopting, implementing or enforcing a rule or policy related to the possession, transfer or storage of a firearm. Under current DCS rules, in the case of foster care homes and facilities, firearms must be unloaded and locked away at all times and, in some cases, banned altogether.  So much for your "right" to keep and bear arms if you wish to foster or adopt a child. It is important to show the legislature that there is support for HB 2535 and your legislators need to encourage the Leadership to remember their constitutional duty is to protect the rights of individuals. andy tobinCommissioner Andy Tobin attended the ITC Holdings Corp. extensive stakeholder meetings held in Prescott yesterday and will attend the meeting scheduled between 3-5 pm., today in Phoenix. The Big Chino Valley Pumped Storage Project is a state-of-the-art 2,000 megawatt (MW) pumped hydro energy storage facility planned in Yavapai, Coconino, and Mohave counties that is anticipated to greatly boost our state’s energy security and resilience. Earlier this month, Tobin proposed the comprehensive Arizona Energy Modernization Plan which includes a target of 3,000 MW of energy storage operating in the state by 2030. The Big Chino Valley Pumped Storage Project would bring Arizona’s total energy storage capacity to 2,326 MW, which would be more than 75 percent of the 3,000 MW goal proposed in Tobin’s Arizona Energy Modernization Plan. According to the information provided to stakeholders by ITC Holdings Corp., the project would be able to store up to 26,000 acre-feet of closed-system water and deliver 20,000 megawatt hours (MWh) at times when electricity is the most expensive to consumers. This is enough to power 3 million homes for four hours. “This project will allow our state to better harness the potential of solar resources and put them to use during expensive peak hours,” said Tobin. “It will also bring billions of dollars and thousands of jobs to the state while helping us avoid the need to build costly new generation facilities. Overall, these types of projects will be major wins for ratepayers in Arizona.” For info http://azcc.gov.

PC Larry Sorenson: Thanks again for your communication. This is the best effort at reaching the PC's that any of us have ever seen. With the mail-in ballot in full swing, the recent accusations flying between candidates may not affect the outcome at all. Right now I believe that the fate of the election is already decided in the recorders’ office mail. In the event that an accusation turns out to be true, we will simply live with the outcome until the next election. There may be some validity to the idea of a short term temporary appointment in light of the proximity to the general election. We taxpayers are out over a million bucks and may forever question our votes.

Leona Johnston, Fountain Hills Republican Club: Frosty, Thanks to you for your outstanding publicizing of the Fountain Hills Republican Club Booth at the Great Fair! Chris Brant, 2nd VP and Booth Chairman, reports that it was a huge success; a large number of volunteers, many candidates getting signatures for petitions and meeting and greeting, voter registrations, “new member” outreach for the club. A final tally of the political survey will be forthcoming, but Chris reports that people were standing in line to take the survey. The mood was very positive. Only one negative incident reported. One person from the neighboring Dem booth wanted to start an argument. And he couldn’t keep up with the constant stream of “happy” Republican taking over the entire area. The American Freedom Alliance (AF) Team: Today was the day of the CD8 House Special Election to elect nominees from both parties to run again on April 24, 2018 to win the seat in Congress. The winner of the Republican election with 36% of the vote is Debbie Lesko.  Following her were Steve Montenegro with 24% despite the revelation late in the early voting period that he is engaged in his own swamp activity with a woman not his wife.  Montenegro enjoyed the endorsements of Congressman Franks himself, Sen. Ted Cruz and Sheriff Arpiao.  Coming in third was "I was the first Legislator to Support Trump" Phil Lovas, also known as the McCain candidate. Brent Backus 2LD13 State Senate candidate Brent Backus: Cruelly to animals is a sin. The AZ Senate just passed SB 1295 by a vote of 16-13 on Feb 26, 2018. The bill makes cruelly to animals a class 5 felony. SB1295 now goes to the house for approval. Who would not want to vote for this bill that prohibits a person from intentionally or knowingly subjecting a domestic animal to cruel mistreatment? My opponent Sine Kerr, of Buckeye, the short term unelected State Senator from LD 13 voted against this bill along with 12 other State Senators. Look at the voting record and you can decide who must visit the Humane Society to view abused pets, or sit down with a grieving family who lost a loved pet to cruel treatment from a human being. Sergio ArellanoCD3 Sergio Arellano: How much do you make Raul? Earlier this month, my good friend Terry Mendoza asked House Democratic Leader Nancy Pelosi, "How much do you make Nancy?" Terry's question stumped the hapless "Leader." If we were to ask Congressman Raul Grijalva how much he makes, the honest response would have to be: 'A lot more than my constituents.' Terry asked the question of Pelosi during a Phoenix town hall featuring Pelosi and Grijalva. The two representatives were bashing the tax reforms passed by Congress this year. Pelosi has dismissed the bonuses that resulted from the tax cuts as "crumbs." They might be crumbs to a multi-millionaire, but for the people of Grijalva's CD3, those crumbs represent opportunity. You see, after Grijalva called for a boycott of his own people, we were all left with nothing but crumbs. CD3 is home to the eighth poorest metropolitan area in the country thanks to Grijalva's boycott. The results of his boycott are still felt today. Because of the boycott, the unemployment rate in CD3 is one of the highest in the country. Too many of Grijalva's constituents can't yet see the benefits of tax reform because they have yet to find employment. At the same time the people of CD3 were struggling to live off crumbs, Grijalva was doling out "hush money" in order to make a complaint by a female staffer go away. The female staffer had complained that he had created a "hostile workplace." Thanks to Grijalva's boycott, the people of CD3 know what it is like to work in a Grijalva-created hostile workplace. Grijalva may not be the wealthiest member of Congress, but he has done a lot to ensure that his people remain some of the poorest in the country. Still optimism remains high and the people of CD3 are ready for new leadership. They are ready for a change. I represent that change. I have confidence that the people of CD3 are looking for a fresh face and a selfless leader. I am that man. We are running a grassroots no-frills campaign. Already I and my volunteers are spanning out across the vast CD3 collecting signatures, hosting meet-and-greets, as well as talking to our neighbors about common sense solutions and common dreams. As I would often tell my fellow infantrymen, "We can do this. We will survive. We can win this!" trent franksBy The End Of The Day, we should know who will be elected to replace former US Representative Trent Franks on Arizona’s congressional delegation. As things got ugly in recent weeks, many who cast early ballots are wishing they had hold off. Little did they know of the allegations that would surface resolving around several of the lead candidates during the last days of the face. It appears Washington, DC isn’t the only place where well entrenched legislators are making ugly headlines. It is disappointing to watch the exposure of shenanigans of legislators who seemingly had served us well. Some resigned their positions to run for the empty US House sent, only to see their shenanigans, weaknesses or hidden secrets splashed across the TV. It appears Arizona has its own “swamp” that needs cleansed. And then we have a bunch of announced candidates, who don’t have a snowballs chance in hell of being elected – but instead of withdrawing they are hanging on, sucking away much needed votes for those who are in lead positions.- ft.

AG Mark BrnovichAttorney General Mark Brnovich joined a 20-state coalition urging a federal district court in Texas to hold the Affordable Care Act’s (ACA) individual mandate is unconstitutional and to enjoin the entire law. The complaint, filed late Monday, explains the ACA, as recently amended, forces an unconstitutional and irrational regime onto the states and their citizens. In NFIB v. Sebelius, the U.S. Supreme Court narrowly upheld the core provision of the ACA - the individual mandate - as a “tax.” However, Congress has recently repealed this tax, while leaving the mandate in place. Since the Supreme Court has already held Congress has no authority to impose such a mandate on Americans, absent invoking its taxing authority, the ACA is now unconstitutional. Wisconsin Attorney General Brad Schimel and Texas Attorney General Ken Paxton filed the coalition’s brief in a federal district court in Texas. In addition to Arizona, other states participating are Alabama, Arkansas, Florida, Georgia, Indiana, Kansas, Louisiana, Maine, Mississippi, Missouri, Nebraska, North Dakota, South Carolina, South Dakota, Tennessee, Utah, and West Virginia. tom_husbandCALL TO ACTION: Former Maricopa County Chairman Tom Husband - Arizona Taxpayer Action Committee: SB1102 is a bill in the State Senate that will help keep homeowners in their homes. It is extremely disappointing and frustrating that some elected officials around the state are more concerned with helping predatory investors than they are with helping homeowners keep their homes. At the County level, with a few exceptions, notably Maricopa County Treasurer Royce Flora and Maricopa County Royce FloraAssessor Paul Petersen, the majority of the other counties’ Treasurers and Assessors oppose SB 1102 which simply allows a Good Samaritan to pay someone’s property taxes and have that treated as a charitable gift. Why would anyone oppose that? The sad answer is those opposing Treasurers and Assessors don’t want to upset big investors who count on poor folks not being able to afford their ever-increasing property taxes so they can take over the property after foreclosure. The Arizona Taxpayer Action Committee (ATAC) is calling them out. Simply put –this is immoral. We are calling on taxpayers to contact their Legislators to vote for SB1102. Elected officials are supposed to provide protection for citizens, taxpayers, and homeowners; in particular, they need to practice good policies that help people keep their homes, not make it easier for vultures to swoop in and eat the carrion.

Polls show that Kennedy is widely known by the electorate having been elected to his fifth term as Louisiana’s top money manager with 80 percent of the vote last fall. The question is whether a state official can use the millions in money leftover from a campaign. A memo, backed by one of the nation’s preeminent lawyers on campaign law, that is circulating around Louisiana political circles, asks that very question. “The answer is no, the memo stated. This tends to show Ms. Lesko is very wrong. I chose this article because it seems the closest to the circumstance that exist in her case.

He is close to being or is a sexual predator pervert. Montenegro asked a woman to send pictures on Snapchat. They engaged in sexual conversation about the pictures. “These conversations were detailed and intimate." she said. “Over the months, we began to flirt. I felt comfortable enough with the relationship that I began to send pictures of myself in various states of undress," she said in a statement read Thursday by her attorney, Tom Ryan. Montenegro’s political strategist CQConstantine “CQ” Querard put out a plea for funds to counter TV ads targeting Montenegro. Do not donate. CQ affiliation is a good reason to not vote for Montenegro. “Querard appeared before the committee to pimp a bill near and dear to his heart, one his vassals obediently voted out of committee with a "do pass" recommendation, House Bill 2551.” In 2013 HB 2551 proposed law would have worked like this:If a judge or government entity issues a subpoena to examine someone's financial records, the financial institution cannot hand over those documents until 21 days after service.”.. . ..“Meanwhile a copy of the subpoena was to be sent to the individual, and the individual had 14 days to make a motion to quash the subpoena.” HB 2551 placed restrictions on warrants for financial information to be used in criminal cases, once again giving the suspect a heads up that he or she is a target of an investigation. Though with a warrant, the target would have to be notified within 90 days. “Shamelessly, Querard admitted that his bill will cause various government agencies headaches.I have no doubt that if you pass this bill, it will at some level make prosecution a little more difficult, he told the committee.” But this HB 2551 was all about Querard and his needs. As many know, this is my first campaign and since I’m not a political insider I rely on advice from friends and relatives on the navigation of this campaign. As part of this journey, I examine other campaigns to identify their funding sources and how the money is spent. One thing I have observed struck me as wrong; however, I checked with professional political figures and legal experts to determine the legality. I am told what I’m going to discuss is TOTALLY LEGAL and an accepted practice in Arizona campaigns. In my previous profession there is an unwritten rule that we tried hard to follow, simply; Don’t do it if it is illegal, unethical or will not pass the headline test. As I look over expenditures of other candidates I see small expenditures for Starbucks, liquor stores, gas stations, fast-food meals, and even meals at nice restaurants - sometimes daily. Again, if it related to the campaign, it is totally legal I am told. In perusing donations for some candidates, they have large donations from PAC’s but also small donations from the people we represent, in amounts as small as twenty dollars. I find the taking of donations for a campaign and using the funds for a double-shot, caramel, iced, low-fat latté a violation of trust with the person who gave you twenty dollars. In my opinion, these fine citizens who are so generous with their precious personal funds do not expect the candidates they support to use their donated monies for luxuries. Instead, they expect to see signs, printed materials, or other professional services directly related to the campaign, not to pay for happy-hour or one’s daily caffeine fix. clair van steenwykCD8 candidate Clair Van Steenwyk: The Race for the House seat that Trent Franks recently had to resign due to his behavior towards staffers in DC seems to be on the rise not only in DC but also in AZ with Steve Montenegro’s behavior as well, and now Debbie Lesko’s lose behavior with what seem to be violations of the Financial Standards of both AZ and the FEC.  It appears the so called front runners former buddies still trashing one another when opportunity knocked to demonstrate just how much they covet this federal seat and will do almost anything to win this race for a guaranteed career in politics that all deny they want. I’ve spectated most of my life in politics by volunteering and doing talk political radio, until I ran the 1st time in 2012 against Jeff Flake and then 14 and 16 vs. Franks, however don’t recall this much political poison in a US House seat specially between those who were joined at the Hip and actually support Franks stating they still Respect him and his voting record. I also hope the participants in this GOP Race realize this dirt will be revisited on them if one of them wins again in August Primary. I hope this gets settled on Feb. 27 with none of them winning, as it could cost US a GOP seat which we can't afford to lose now or in Nov.Jean and I thank all who've supported us and let’s hope to change History in AZ on Election Day.
