They would love to take the legislature this year. Let's not let that happen. Most of the Democrats running try to out conservative the conservatives with their talk of supporting the Constitution and right issues. Just know that you need to vet the candidates thoroughly before you vote. The Democrats running for CD#8 have avoided putting their party affiliation on their literature.” The long-time conservative legislator has always stood her ground. Arizona Citizens Defense League (AzCDL), Legislative Update: We thank everyone who used your RTS accounts to register your opinion about HB 2535 and SB 1374 this week.  HB 2535 passed out of committee and we were able to stop SB 1374 from progressing any further.
Friday, February 16 marked a critical juncture for legislation.  Any bills not passing out of committee on that date are effectively dead for the remainder of the session.  Of the 31 bills we are monitoring, 19 failed to meet the February 16 deadline.  The good news is that the 14 anti-rights bills we opposed have been stopped in their tracks.  Unfortunately, we will see most of them filed again next year.The following is the status of key pro-rights firearms bills that survived the February 16 deadline and must now pass full chamber debates and floor votes in order to stay viable.  The status of all the bills we are monitoring can be found at AzCDL's Bill Tracking page.  We encourage you to review them.

· HB 2059, which would establish the "Arizona Citizens Marksmanship Program" for militia member training and equipment, passed out of the House Federalism, Property Rights and Public Policy (FPRPP) committee on Tuesday, January 30.

· HB 2172, which would prohibit most Arizona colleges and universities from banning "non-lethal" weapons passed out of the House on February 15 and was transmitted to the Senate where the hearing and voting process starts all over again.

· HB 2211, an AzCDL-requested bill that would exempt your firearms from a personal bankruptcy process, was scheduled for a House Committee of the Whole (COW) debate on February 15 but was pulled from the agenda after the school tragedy in Florida.  Since Republican legislators increasingly show signs of lacking the fortitude and integrity to stand up to political correctness, we are in the process of preparing an email that you can send to your legislators urging them to support HB 2211 and remind them that you are watching how they vote.

· HB 2535 would add language to the statutes regarding the Department of Child Safety that "Notwithstanding any other law, the Department, the Director, a Child Welfare Agency or a Governing Board of a Child Welfare Agency may not adopt, implement or enforce a rule or policy that relates to the possession, transfer or storage of a firearm."  Thanks to your RTS activism, HB 2535 passed out of the House Judiciary committee on February 14.

· HCR 2002, a proposed ballot measure that would remove the upper age limit for militia members, passed out of the House, Military, Veterans and Regulatory Affairs (MVRA) committee on January 29, 2018.

Bills that survived the February 16 committee hearing deadline must now pass out of their originating Chamber (House or Senate) and face their next deadline on March 23.  That's when House bills must pass out of Senate committees and all Senate bills must pass out of House committees. As bills are scheduled for COW hearings and floor votes in their originating chamber, we will alert you to use AzCDL's Legislative Action Center to contact your Representatives or Senator with emails we have prepared for you.  As bills are scheduled for new committee hearings, we will notify you to use your RTS accounts to register your opinions with committee members.

Phoenix City Councilman Sol DiCiccio reports that City of Phoenix Offices will be closed Mon, Feb 19 in observance of the President’s Day Holiday. Here are how city services are affected: 

· Solid Waste: rash and recycling will be collected as usual. There will be no change in collection day. Please place your trash and recycling containers 4 feet apart at the curb by 5:30 am.

· Transfer Stations: The 27th Avenue and North Gateway Transfer Stations will be closed

· Transit: Phoenix buses, Dial-a-ride, and Valley metro Light Rail will operate on a Sunday Schedule. Express and Rapid routs will not operate, and customer Service will be 8am-5pm. Visit for more information.

CALL TO ACTION: Tom Jenney, Americans For Prosperity – Arizona: The Tax Cuts and Jobs Act passed by President Trump and Congress is a big win for Arizona workers, families and job creators, cutting both individual and corporate rates while simplifying the tax code. There is only one downside to all of this good news: the Arizona Department of Revenue has released a conformity report showing that Arizona taxpayers will end up paying as much as $250 million more in state (note: NOT federal) income taxes next year, and that number could climb to over $300 million the following year. The tax increase will NOT be caused by Arizona policy makers.  Arizona automatically conforms its state tax code to the federal tax code. Because the federal tax code has now closed several exemptions, more revenue will be going to the state treasury. But we can TAKE ACTION! We must urge Arizona's legislators to reduce state income tax rates and return the excess money to our hardworking taxpayers. Activist Nancy Plencner: Stopping by our favorite Irish Pub in Sydney, Australia yesterday we were spotted as Americans and the bartender asked about the horror of the Florida school shooting. What can one say? It's a tragedy that has been preceded by dozens of other tragedies and we must do more than light candles, hold vigils and mourn the dead. In countries where the citizenry generally do not have guns, or at least not as easily obtained as in the US, they look at us and shake their heads questioning our sanity for allowing these terrible shootings to continue. For some reason this latest sacrifice of young lives seems to feel like a tipping point, to where I do not know. But as a culture, as humans there must be something more to be done to protect our children.

Warren Woodward of Sedona: Would you have confidence in getting a fair trial if, on the first day, the judge opened with "I've never had a proceeding like this, I ask for everyone's patience as we figure out how to proceed." As we figure out?" We?! Isn't figuring out how to proceed something the judge should do before showing up?  Jane Rodda is an Administrative Law Judge (ALJ) at the Arizona Corporation Commission (ACC), and is the ALJ overseeing the formal complaint against Arizona Public Service (APS) regarding APS's recent rate increase granted by the ACC. The complaint, brought about via a petition organized by APS customer Stacey Champion, seeks a rehearing of the rate case since, for many customers, rates are up way more than the "minimal 4.5% increase" that APS and the ACC touted. Rodda has been a lawyer for 28 years and at the ACC for 23 years. Rodda is Chief ALJ and heads the entire Hearing Division at the ACC. Champion's petition was filed on the Jan 3. On Feb 15, a Procedural Conference was held regarding the petition's complaint. Rodda had six weeks to get her act together instead of coming to the Conference unprepared. The good news is that Rodda did not dismiss the case, although that's still an option since she did not rule on APS's Motion to Dismiss yet. My prediction is the case will proceed so that the ACC can continue its longstanding pretense of listening to the public, but Rodda will eventually conclude the case in APS's favor so that the ACC can continue its longstanding practice of screwing the public. As someone who signed Champion's petition, I am a party to the case. I filed a Declaration of Support last Monday. See filing My rate increased 16.8%. My usage actually decreased by 9.88%. I being ripped off but there is no way I can reasonably conserve enough electricity to offset the increase. I am fortunate in that I can afford to give APS more money to waste on executive pay (e.g., CEO = $19M/yr.) and boondoggles like "smart" meters (100s of million$). However, there are many people who cannot. I don't know how the culprits in this colossal scam can sleep at night. I guess anything's possible without a conscience.

Supt of Public Instruction candidate Frank Riggs: There is obviously something seriously wrong within the FBI that they would "file and forget" a "credible and specific tip" about the Florida shooter warning of potential for a school attack.  This agency is obviously suffering from poor morale, poor communication and dysfunctional leadership.  I hope Pres. Trump and AG Sessions address these problems immediately. If the FBI and local law enforcement had followed up and contacted the Parkland shooter, it's likely he would have been identified as a threat to himself and others. That is the definition of mental illness under the law that would have precluded the shooter from passing a background check and purchasing a firearm. fbi-didnt-follow-up-on-tip-from-person-close-to-florida-gunman- Every school needs training on dealing with an active shooter. Schools are "soft targets" that need to be hardened through controlled entrances with metal detectors.  All other doors need to be locked at all times with panic bar exit devices. School Resource Officers (sworn, trained, armed law enforcement officers) can provide a uniformed presence in our schools.  That presence is a proven deterrent, as I know from firsthand experience as a former police officer and crime prevention specialist who did many drug awareness and prevention presentations in K-12 schools.  The uniformed SRO's need to be present at the times of maximum vulnerability, i.e., before school and during dismissal (busing), and at school assemblies.  Experienced SRO's can also act as teachers and counselors themselves.   Classroom teachers need training in recognizing troubled students, as well as bullying (and cyber bullying), and to have the ability to make referrals to school administrators and counselors/psychologists. Schools need to cooperate with local law enforcement, juvenile authorities and the local courts (justice system).  I know of schools that have ignored "orders of protection" issued by local courts to protect one student from being harassed, threatened and intimidated by another student.  Instead of expelling the harasser or moving the student to an alternative school, the school has simply ignored the court order and allowed the harassing student to continue attending the same school. I'm serious about school safety & the security of our students and educators. 

Supt of Public Instruction candidate Franks Riggs Responds to Supt of Public Instruction candidate Bob Branch's commentary 2-17-18-briefs : One of my opponents in the Republican Primary for Supt. of Public Instruction continues to hurl wild accusations and call names.  Candidates who resort to these tactics are desperate.

Yesterday's Briefs published his latest attack and a bill I co-sponsored as a Member of Congress in 1996.  You'll note the conservative members of the California Republican Congressional Delegation co-sponsored and supported this legislation.  We were united in requiring the federal government to reimburse the states, especially the border states (including Arizona), for the costs attributable to illegal immigration, i.e., education, incarceration and public health care.  We introduced bills addressing each of these areas in response to the repeated efforts of the Clinton Administration and the Democratic minority in the U.S. Senate to block meaningful immigration reform legislation (some things never change!). The U.S. Supreme Court ruled in Plyler vs. Doe (457 U.S. 202 (1982)) that states must provide a free education for illegal aliens.  The Court held that "undocumented" children and young adults have the same right to attend public primary and secondary schools as do U.S. citizens and permanent residents.  As a result of the Plyler ruling, public schools may not:

· Deny admission to a student during initial enrollment or at any other time on the basis of undocumented status.

· Treat a student differently to determine residency.

· Engage in any practices to "chill" the right of access to school.

· Require students or parents to disclose or document their immigration status.

· Make inquiries of students or parents that may expose their undocumented status.

· Require social security numbers from all students, as this may expose undocumented status.

This is still the "law of the land" which apparently this opponent has difficulty understanding.  It's also why we felt so strongly in 1996 that the federal government should reimburse the states given the lack of action on immigration reform.
