Supervisor Denny Barney: As we celebrate Valentine's Day this week, we also say "Happy Birthday" to Maricopa County, established 147 years ago in 1871, as part of the Arizona Territory. February 14th is also Arizona Statehood Day, celebrating when Arizona became the 48th State in 1912.

In Honor Of Statehood Days, Supt Of Public Education Diane Douglas will present awards to the top three school in in the WeAreAz 4th Grade Statewide Collaborative Art Competition between 6-8 pm, Wed., Feb 14 at the Sonoran Arts League (7100 E. Some Misguided Individual recently referred to former Maricopa County Republican Chairman Lyle Tuttle as a “RINO” in a blog message. Over his more than 15 years of dedication to Arizona’s grassroots Republicans, he’s been tagged with numerous labels -- but a RINO he definitely is NOT! Tuttle is unquestionably a staunch conservative and for anyone to mislabel him as a RINO obviously has never had a conversation with him, nor do they know anything about him.

Maricopa County Republican Committee Chairman Chris Herring is calling for precinct committee willing to serve on the Handcount/Audit Board for the CD8 Special election. You need to be available March 1 for this full-day, compensated job. Former Sen Russell Pearce: ASU President Michael Crow apparently thinks Arizona voters are too stupid to understand “illegal.” His basis to claim that ASU will provide an education to all “Arizonans” is flawed in many respects. Crow ignorantly cites the AZ Constitution on our responsibility to educate everyone? First of all, the Arizona Constitution is written for Citizens and the specifics are left up to the legislature. ASU is spending millions in breaking the law, while slapping Arizona voters in the face. Crow wants to continue to break the law, even after the Appellate Court ruled unanimously that in-state tuition for illegals was illegal while out of state “citizens” must pay out-of-state tuition. In-state tuition for so-called “Dreamers” is illegal under Arizona law. The Board of Regents, including ASU, are required to obey the law and the State of Arizona is required to enforce the laws. With Proposition 300, Arizona voters said “NO” to in-state tuition, grants or scholarships or any tax subsidy, direct or indirect, to illegal aliens. Proposition 300 was overwhelmingly passed (73%) by Arizona voters who said “NO” to the so-called “Dream Act.” Federal Judge Neil Wake said, for government not to enforce its immigration laws hurts the most vulnerable amongst us. DACA is an illegal, unconstitutional Executive Order by corrupt President Obama that gave thousands of “Dreamers” false hope and did great damage to the rule of law and the Constitution– shame on him. We are a Nation of laws; we either stand up for the principles that are to ensure lasting Liberty enshrined in our Constitution, or we sow anarchy by having our emotions drive our actions. Arizona Citizens pay $2.6 billion per year to educate, medicate and incarcerate illegal aliens in our State. The Arizona Board of Regents voted to grant illegal aliens in-state tuition, in direct violation Arizona law and a great cost to taxpayers.  It’s a felony under federal law to aid, abet, encourage or help an illegal alien stay in this country. Arizona law passed in 2006 by 75% of voters made it very clear that illegal aliens cannot receive in-state tuition, grants or scholarships to attend higher ED.  The law is clear.  According to Kansas Secretary of State Kris Kobach, an attorney and Constitutional scholar, “as a legal question” DACA is not even close. DACA is illegal for at least five reasons: three violations of federal law and two violations of the United States Constitution:” And in Arizona a violation of state law. Federal law violations:

1. 8 USC 1225(b)(2). This statute requires that any alien an ICE officer determines to be inadmissible “shall” be placed in removal proceedings.

2. The Administrative Procedure Act (APA). Obama violated federal law. The Fifth Circuit already came to this conclusion in Texas v. United States.

3. “Prosecutorial discretion” cannot be used to confer federal benefits. DACA doesn’t follow those avenues. The Fifth Circuit reached this conclusion as well in Texas v. United States.

United States Constitution violations:

1. The Constitutional Separation of Powers. The granting of the right to remain in the United States, plus employment authorization, is a legislative action.

2. Article 2, section 3, of the U.S. Constitution. The Constitution requires the president to “take care that the laws be faithfully executed.”

3. “Prosecutorial discretion” cannot be used to confer federal benefits. DACA doesn’t follow those avenues. The Fifth Circuit reached this conclusion as well in Texas v. United States.

ARIZONA LAW: ARS 15-1803. Alien in-state student status A.  A person who is not a citizen of the United States, … without lawful immigration status … enrolled as a student at any university …under Arizona board of regents or at any community college … in this state is not entitled to tuition waivers, fee waivers, grants, scholarship assistance, financial aid, tuition assistance or any other type of financial assistance that is subsidized or paid in whole or in part with state monies.

I am convinced that these items alone will provide us with the America First immigration and border security policies we desperately need. Despite the Left and their Republican Establishment allies like Sanctuary Senator Jeff Flake, I know that the vast majority of Americans agree that there can be no immigration reform without border security and the Wall. Of course, it's my hope that Congress will reach a consensus this week and agree upon a common-sense solution to secure our borders and end bad immigration policies like chain migration... but, unfortunately, I'm not expecting much. With so many “Amnesty First” Senators like Jeff Flake and John McCain, I'm just not convinced that we'll see the fixes we deserve by the weekend. Congressman Andy Biggs regarding the stalled Senate deliberations on border security and immigration reform: “Today, Democrats objected to debating amendments on legislation regarding sanctuary cities. This objection came on the very first amendment offered and shows, once again, that their party is more concerned with using immigration as a political wedge. The American people gave President Trump and this Congress a mandate to build the wall and fully secure the border – and we must do just that – before considering any other immigration legislation. Because of the Senate’s lack of courage to take tough votes and their outdated filibuster rules, we have done neither. Time is running out, and all Americans will be affected by our decisions and delays.”

Senator Sylvia Tenney Allen: How to Identify Legal Plunder - "Quite simply.  See if the law takes from some persons what belongs to them, and gives it to other persons to whom it does not belong."  Frederic Bastiat. There are two bills that have been heating up the email and phones! SCR1016 minimum wage; sick time repeal was heard in Commerce and Public Safety Committee on Monday. This is my bill, and it would hold the minimum wage at $10.50 and repeal the sick time leave.  Wages and benefits must be between the employer and employee.  Businesses should have the freedom to determine what they can do within the confines of their business profit margin. The consequences of Prop 206 which raised the minimum wage, have been felt most by small businesses.  The Moms and Pops, small enterprises that are the backbone of rural Arizona, are feeling the consequences of the mandatory wage increases.  Some will close their doors.   As time goes on, if we don't change this law then the far-reaching consequences are that only large corporations and chain businesses will be left. Michelle D. Sims, Professor of Economics, Arizona Western College is doing her Doctorate on the effects of mandatory wage increases on small businesses.  She testified in favor of the bill.    So far, she has found that 80% of the business that she spoke with have cut the hours of their employees, 80% have increased their product prices, and 70% are only hiring experienced workers.  Donna, who has owned a small business for 40 years in Yuma, said that she will not be able to absorb the $12.00 minimum wage increase.  There is not the profit margin in her specialty shop selling candy and nuts. Ronny's 34-year-old pizza business can't compete with the pizza chains and mandatory sick time.  His employees are high school students. There were many who testified against my bill.

· One women from the Domestic Violence Coalition claimed that a low minimum wage increases domestic violence.

· Testimony was given that those businesses who could not afford the new wages were badly run businesses. 

· Much of the anti-testimony was built upon socialism and redistribution of the wealth.

My position is that government is here to protect individual rights and property rights.  We do not have a right to force businesses to pay any wage.  A higher minimum wage will not relieve poverty.  More education or workforce training will lift people out of poverty.  Lowering the cost of living would give everyone a raise!

Senator Sylvia Tenney Allen: SB 1391; schools suicide prevention training, is not my bill but was assigned to my Education Committee.  I received a great number of emails and phone calls.   I was willing to give it a hearing, but the sponsor, Senator Bowie, held the bill because it had been double assigned to the Health Committee and the Education Committee.  The chairman of Health was not going to hear the bill, which stopped the bill from moving forward.  

Teenage suicide is a tragic subject.  The bill would have mandated that school district require their teachers and administrators attend a program designed to train them to recognize signs of possible suicide tendencies in our youth.  We put tremendous pressure on our schools to be aware of, and to solve social ills that plague our society.   Once they are given this responsibility, then they also have the liability.  Title 15, which is the statute that regulates our schools, is over 3 inches thick.   Education organizations fight hard to stop any mandates that put more responsibility upon them the teachers and schools. Right now, there is nothing stopping any school district or charter from providing this type of training for their teachers.  They have local control over this issue.Early on when I was getting emails to hear this bill, I made a comment about family responsibility for this issue and was criticized.  Any issue that affects our youth, whether it be drug addiction, teen pregnancy, suicide, etc., families are the first line of defense.  My comment was not meant to be insensitive to any family who has experienced this tragedy, but was meant to include families to be educated and strengthened to deal with the challenges of our youth.  In the end, our children have their agency, and after all we do they still make choices that can break our hearts.

Black Canyon Hwy, Access Rd, Dunlap Ave Exit off I-17.  Eagle Forum is a conservative interest group founded by Phyllis Schlafly in 1972 and is the parent organization that also includes the Eagle Forum Education and Legal Defense Fund and the Eagle Forum PAC. The Eagle Forum has been primarily focused on social issues; it describes itself as pro-family and reports membership of 80,000. Others have described it as socially conservative and anti-feminist.  Ellsworth will focus on the dangerous aspects of having a Constitutional Convention of States or a Con Con.
